TERMS AND CONDITIONS OF SALE

1. DEFINITIONS AND OBJECT OF THE CONTRACT
1.1 This contract (“Contract”) is a distance contract pursuant to Legislative Decree 6 September 2005, no. 206 (“Consumer Code”).
1.2 The Contract concerns the sale of movable goods between Felin by Federica Parmeggiani, with registered office in Via Luigi Caldieri, 127 – 80128 Naples, VAT number 09880401212 (hereinafter also “Felin by Federica Parmeggiani” or the “Seller”) and the end consumer (hereinafter the “Customer”).
1.3 The Contract is concluded with the acceptance by Felin by Federica Parmeggiani of the purchase proposal sent by the Customer through the website www.federicaparmeggiani.com (the “Site”) or through other distance selling systems used by the Seller, according to the procedures indicated in article 3 below.

2. PRICES
2.1 The prices of the products indicated on the Site are expressed in Euros, include VAT and any other applicable taxes.
2.2 Delivery costs are not included in the price of the products and are indicated separately before order confirmation.

3. PURCHASE AND PAYMENT METHODS
3.1 The Customer selects the products on the Site, adds them to the cart and completes the order by following the online procedure. Before final confirmation, the Customer can check and correct any errors.
3.2 Payment for the products can be made using one of the methods indicated on the Site, including by way of example:
- PayPal,
- Credit card,
- Bank transfer,
- Other payment methods indicated from time to time as valid by Felin by Federica Parmeggiani.
In case of payment by bank transfer, the order will be processed upon verification of the actual credit.

4. DELIVERY OF PRODUCTS AND COMPLAINTS
4.1 Products are delivered to the address indicated by the Customer during the order. Delivery times are estimated to be a minimum of 10 working days and a maximum of 14 working days from the conclusion of the Contract, unless otherwise specified on the Site. Times may vary depending on the model and complexity of the garment.
4.2 Any complaints relating to defects, non-conformity or delays in delivery can be sent to:

5. PRODUCT AVAILABILITY
5.1 Felin by Federica Parmeggiani produces garments by hand after receiving the order. The acceptance of the order is therefore subject to the availability of raw materials.
5.2 In case of sudden unavailability (for example due to out of stock fabrics or laces), the Seller undertakes to promptly inform the Customer and to propose, where possible, alternative solutions or a refund of the amount already paid.

6. GUARANTEES AND ASSISTANCE
6.1 Products purchased by the Customer are subject to the provisions of the Consumer Code regarding the legal guarantee of conformity of consumer goods.
6.2 In case of a defective or non-conforming product, the Customer has the right to the remedies provided by law (repair, replacement, price reduction or termination of the contract, in the cases permitted).

7. CUSTOMER OBLIGATIONS
7.1 The Customer declares and guarantees:
- to be a consumer within the meaning of art. 3 of the Consumer Code;
- to be of legal age;
- that the data provided is true, correct and up-to-date;
- to have read and accepted these Terms and Conditions before confirming the order.

8. RIGHT OF WITHDRAWAL
8.1 The Customer has the right to withdraw from the Contract within 14 working days from the receipt of the products, as provided for by the Consumer Code.
8.2 Withdrawal can be exercised by written communication to be sent to Felin by Federica Parmeggiani (to the addresses indicated in art. 4) via registered letter with return receipt, certified email, email or other suitable means to prove the sending.
8.3 For hygienic-sanitary reasons, it is not possible to return briefs, thongs and bodysuits, unless the product is non-compliant or defective compared to the description.
8.4 The Customer may exercise the right of withdrawal in cases where the product is damaged, does not conform to the description or has obvious manufacturing defects.
8.5 Products must be returned to the address:

within 14 days of receipt, following the instructions provided by the Seller.

9. ARTISANAL NATURE OF THE PRODUCTS
9.1 Felin by Federica Parmeggiani does not have a stock production: garments are made to order based on the parameters provided by the Customer, including any request for specific measurements.
9.2 Due to the artisanal nature of the processing, each product is unique and may present minimal differences compared to other garments of the same line: this constitutes a sign of craftsmanship and not a defect.

10. RETURNS FOR DEFECTS OR MANUFACTURING ERRORS
10.1 In the event that the product presents obvious manufacturing errors or defects, the Customer has the right to request the repair or replacement of the garment.
10.2 If repair or replacement is not possible, the Customer will be entitled to a partial or total refund of the order, depending on the state of the product and any use made.
10.3 The refund will be made as soon as possible, and in any case within 30 days of receipt of the return or proof of shipment.
10.4 Each case will be evaluated individually. The Customer is advised to keep proof of shipment of the returned package.

Personal data is processed in accordance with Regulation (EU) 2016/679 (“GDPR”) and applicable national legislation.

2. TYPES OF DATA PROCESSED AND PURPOSES
Through the Site, the following may be collected and processed:
- personal and contact data (name, surname, address, email, telephone);
- data necessary for order fulfillment (shipping address, billing data);
- browsing data (IP address, logs, cookies).

Data is processed for the following purposes:
- order management and fulfillment of the sales Contract;
- management of payments, shipments, returns and customer assistance;
- legal, accounting, tax and administrative compliance;
- sending informative and promotional communications (with consent, where required).

3. LEGAL BASIS FOR PROCESSING
Data is processed:
- because it is necessary for the performance of the Contract to which the Customer is a party;
- to comply with legal obligations;
- on the basis of the legitimate interest of the Controller (for example to improve services, prevent fraud, protect its rights);
- on the basis of consent, for direct marketing activities where provided.

4. RETENTION OF PERSONAL DATA
Personal data will be kept for the time strictly necessary for the purposes for which they were collected and, subsequently, for the period provided for by current regulations (for example on tax and accounting matters).
In the case of processing based on consent, the data will be kept until the consent is revoked.

5. ACCESS AND COMMUNICATION OF DATA
Data may be processed by authorized personnel of Felin by Federica Parmeggiani and by third parties acting as data processors (for example IT service providers, couriers, consultants).
Data will not be sold or transferred to third parties for independent marketing purposes.

6. RIGHTS OF THE DATA SUBJECT
The user can at any time exercise the rights provided for by the GDPR, including:
- right to access personal data;
- right to rectification and updating;
- right to erasure (“right to be forgotten”) in the cases provided for;
- right to restriction of processing;
- right to data portability;
- right to object to processing, also for direct marketing purposes;
- right to lodge a complaint with the Garante per la Protezione dei Dati Personali (Italian Data Protection Authority).

1. WHAT ARE COOKIES

In case of late payment, default interest as provided by law may be applied.
Felin by Federica Parmeggiani reserves the right to request advance payment for the order.

FORCE MAJEURE
In the event of force majeure or unforeseeable circumstances (for example: strikes, natural events, service interruptions, pandemics, etc.), Felin by Federica Parmeggiani cannot be held responsible for delays or non-execution of the Contract and reserves the right to suspend, defer or terminate the Contract, in whole or in part.

COMPETENT COURT
This Contract is governed by Italian law.
For any dispute relating to the interpretation, execution or validity of the Contract, the Court of Naples shall have exclusive jurisdiction, except in cases where the law provides for the mandatory jurisdiction of the consumer's court.
